Managing Domestic Inquiry Effectively – Legal & Practical Perspectives With Mock Trial Simulation : Domestic Inquiry Ensuring Fair Procedure and Legal Compliance Handling employee misconduct requires employers to adopt fair, transparent, and legally compliant disciplinary procedures. Failure to conduct disciplinary proceedings properly may expose organisations to unfair dismissal claims, Industrial Court disputes, and reputational risks.

A Domestic Inquiry (DI) is a critical mechanism used by employers to investigate allegations of misconduct and determine whether disciplinary action should be taken. The process must be conducted in accordance with the principles of natural justice, ensuring that employees are given a fair opportunity to defend themselves while enabling management to make informed decisions.

This two-day programme provides participants with a comprehensive understanding of Domestic Inquiry procedures, including the legal framework, proper documentation, roles of the inquiry panel, and effective management of witnesses and evidence.

Module 2: Legal Framework Governing Domestic Inquiry

Learning Objectives : Participants will understand the legal principles governing disciplinary actions in Malaysia.

    • Right to be heard
  • Burden of proof in disciplinary cases
  • Importance of fairness in Industrial Court cases

Module 3: Domestic Inquiry Procedures 

Learning Objectives : Participants will understand the step-by-step procedures required before and during a DI.

  • Investigation before disciplinary action
  • Issuing a Show Cause Letter and Employee explanation
  • Issuing Notice of Domestic Inquiry
  • Preparation of evidence
  • Preparing witnesses

Practical Exercise : Participants review sample disciplinary documents and identify procedural weaknesses.

Module 4: Roles And Responsibilities In Domestic Inquiry

Day 2 – Practical Application & Mock Trial

Module 6: Evidence And Witness Handling 

Learning Objectives : Participants will learn how to manage evidence and witnesses effectively.

  • Evaluating credibility of witnesses

This is the highlight of the training program me. Participants will conduct a simulated Domestic Inquiry hearing based on a realistic workplace misconduct case.
